1. The instant contempt application was taken out complaining non compliance of the judgment and order dated 28th April 2023.

2. By order dated 28th April 2023, this Court while allowing an application under 17B of the Industrial Disputes Act, 1947, had directed the opposite party / petitioner to make payment of the last drawn wages as payable to the applicant at the rate of 4000/- per month as stated in the application from the date of filing of the writ petition, i.e., 6th December 2021.

3. Pursuant to the rule issued on 7th August 2026, Mr. Sandeep Kumar Ladiya and Vineta Ladiya being the contemnor nos. 1 and 2 respectively are personally present in Court today.

4. It is submitted that due to oversight the payment for four months had not been disbursed in favour of the petitioner. There is no particulars in the affidavit of compliance filed as to when the contemnors had been apprised of such fact and as to when such enquiry was made by the contemnors.

5. The explanation provided does not appear to be appropriate to say the least. The entirety of the circumstances read together would inevitably lead to a conclusion that the contemnors had failed to adhere to the directives of this Court in its letter and spirit.

6. However, considering the apology tendered by the contemnors in Court today and on their undertaking that they shall abide by the orders of the Court in future, I am of the view that the matter need not be proceeded any further and the same is disposed of.

7. In view thereof, the contempt application being CPAN 767 of 2025 is disposed of, the rule stands discharged.

8. The personal appearance of the contemnor nos. 1 and 2 are dispensed with.

9. All parties shall act on the basis of server copy of this order duly downloaded from this Court’s official website. (Raja Basu Chowdhury, J.)
