1. Mr. Mukherjee, learned advocate appearing for the municipality by placing before this Court a demolition order dated 21st October 2024 being Demolition case no. 21-D/III/24- 25 in respect of premises no. 45A/H/3, Cannal East Road, Ward no. 29, Borough – III, submits that though the above order was carried in appeal before the Municipal Building Tribunal, by order dated 11th February 2026, the same has been dismissed as would corroborate from the Building Tribunal Appeal no. 19 of 2025 with a cost of Rs.2000/-. According to him, the municipality has been carrying on demolition proceedings in terms of the above order. The municipality has not proceeded in respect of any other premises and the demolition proceedings is confined to premises.no.45A/H/3, Cannal East Road, Ward no. 29, Borough – III.

2. Having heard the learned advocates appearing for the respective parties and retaining the above order in the file, I am of the view that in the peculiar facts, no further order is necessary since the municipality has not proceeded against any other premises and the writ petition is accordingly disposed of.

3. All parties shall act on the basis of server copy of this order duly downloaded from this Court’s official website. (Raja Basu Chowdhury, J.)
