CRM (NDPS) 2112 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Sealdah GRPS PSCase No. 77 of 2025 dated 19.07.2025 u/s 20(b)(ii)(c)/29 of the NDPS Act.

In the matter of : Ratna Dutta

… Petitioner(s)

Mr. Angshuman Chakraborty Mr. S. S. Saha

… for the Petitioner(s)

Mr. Brajesh Jha, APP Mr. Ranjan Chakraborti Mr. Abhijit Singh

… for the State-respondent(s)

Learned advocate for the petitioner submits that four persons were intercepted who were not known to each other. Learned advocate also submits that individual seizures were summed up and the investigating agency shows the recovery of 51.210 kg of ganja. State opposes the prayer for bail and submits that seizures were effected from the persons who were available at the same train. Having considered the quantum of seizure in the present case, I am not inclined to release the petitioner on bail as the rigors of section 37 of the NDPS are attracted. Hence, the prayer for bail of the petitioner is Rejected.

However, State would expedite the process of trial as till date none of the witnesses have been examined. The independent seizure list witnesses in each of the seizures be given priority for examination. The petitioner would renew his prayer for bail after six months from the next date fixed before the learned trial court. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. State would communicate this order to the learned trial court. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
