CRM (M) 2418 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Jadavpur PS Case No. 154 of 2025 dated 12.10.2025 u/s 64(1)/BNS, r/w 4/6 of the POCSO Act.

In the matter of : Arpan Nag Chowdhury

… Petitioner(s)

Ms. Saba Parween

… for the Petitioner(s)

Mr. Pawan Kumar Gupta Mr. ADitya Ratan Tiwari

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner is in cstody for almost a year and till date charges have not been framed. The petitioner claims innocence as there is hardly any material to support the prosecution’s case. State opposes the prayer for bail and draws the attention of the court to the statement of the informant. I have taken into account the overall circumstances of the case. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.

2 However, the petitioner would renew his prayer for bail after the evidence of the victim is over. The learned trial court is directed to expedite the process of consideration of charges and examination/deposition of the victim preferably within a period of three months from the next date fixed. Accordingly, CRM (M) 2418 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence and the report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
