In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Murutia PS Case No. 217 of 2025 dated 14.08.2025 u/s 21(c)& 25 of the NDPS act.

In the matter of : Dukhu Sardar

… … Petitioner(s)

Mr. Sumanta Das

… for the Petitioner(s)

Mr. Indradip Das Ms. Tatini Sengupta

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner is in custody for about two months; charge-sheet has already been submitted and he has been implicated in the instant case on the basis of statement of a co-accused. State opposes the prayer for bail and submits that the petitioner obtained the vehicle from the owner and lent out to one of the accused persons. Having considered the complicity of the present petitioner in the instant case, inspite of the fact that there has been recovery of 1800 bottles of phensedyl, I am of the opinion that custodial detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Dukhu Sardar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), Krishnanagar, Nadia. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Nadia without prior permission of the learned Special court/trial court or the court in seisin of the case. Accordingly, CRM (NDPS) 2157 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
