1. By consent of the parties, the matter is taken up for hearing.

2. It is submitted on behalf of the appellant that they undertake to cure all the defects in this appeal.

3. It is fairly submitted on behalf of the appellant that they do not want to proceed with this appeal and seek liberty to withdraw the same.

4. The instant appeal is directed against an order dated 19.06.2018. Briefly, the writ petitioner/appellant had challenged a show- cause notice dated 01.11.2017 issued by the Enforcement Directorate. By the impugned order the Learned Trial Court has after recording that the writ petitioner had comprehensively dealt with the notice dated 01.11.2017 dismissed the writ petition being premature. All points had been left open for the writ petitioner to take up before the Appropriate Authorities in accordance with law.

5. Being aggrieved by the said order, the instant appeal has been filed. By an order dated 28.11.2018 a Co-ordinate Bench had inter alia directed that though the appellant was to participate in the departmental adjudication but the final order of adjudication would not be pronounced and should be kept in a sealed cover deposited with Court. By the said order, the Co-ordinate Bench had also directed that no coercive steps be taken against any of the appellants or the directors or their principal officers.

6. It is submitted on behalf of the Enforcement Directorate that during the pendency of this appeal, a final adjudication order dated 18.05.2023 has already been passed and the appellant has been found liable to pay a sum of approximately Rs. 6,50,00,000/-. The order dated 06.07.2023 passed by the Enforcement Directorate has been communicated to all the parties.

7. In view of the above, and the concessions made on behalf of the appellant, nothing survives in this appeal. MAT 590 of 2018 alongwith the connected pending applications stand dismissed as withdrawn.

8. Interim orders, if any stand vacated.

9. Liberty is granted to the Enforcement Directorate to act in accordance with law.

10. It is made clear that there has been no adjudication on the merits of the case and all issues are left open for the Appropriate Authority to decide in accordance with law.
