09.10.2026 Serial no. 211 [G.S.Das] Assistant Registrar (Court)

CRM (M) 2633 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with STF (HQ) Case No. 02 of 2026 dated 16.01.2026 u/s 25(1a)/25(1B)(a)/25(6)/25(8)/35 of the Arms Act.

In the matter of : Tiwari Kumar

… Petitioner(s)

Mr. Kushal Kr. Mukherjee Mr. Surajit Basu Ms. Jasika Alam

… for the Petitioner(s)

Mr. Kallol Mondal, ld. PP Mr. Aditya Tiwari Ms. Namrata Chatterjee

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner is innocent and has been implicated only on the basis of statement of a co-accused. State opposes the prayer for bail and submits that there are not only antecedents of the present petitioner but also in the seizure list of recovery of Arms, petitioner’s signature is available. As such, it can be assumed that recovery was from the possession of the present petitioner. Having considered the same, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.

2 Accordingly, CRM (M) 2633 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
