08.10.2026 Court No.35. D/L. 13. Kausik (Rejected)

CRM (NDPS) 2057 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Basirhat Police Station FIR No. 141/2026 dated 18.02.2026 under Section 21(c)/29 of the NDPS Act, 1985.

And In the matter of : Salim @ Selim Sardar

……Petitioner.

Ms. Malashree Ghosh

……for the Petitioner.

Mr. Subrata Mukherjee Mr. Haripada Nayak Mr. Shoumilya Mazumder

……for the State.

State has produced a report. Report reflects that there are 3 criminal antecedents of the petitioner including one case under the NDPS Act and another under the Arms Act. In the present case 50 bottles of Wincerex Cough Syrup was recovered. Petitioner is in custody for more than 7 months. Although, charge sheet has been submitted but petitioner having a criminal antecedent, I am of the opinion that the rigors of Section 37 of the NDPS Act will attract in the present case.

As such, prayer for bail of the petitioner in CRM (NDPS) 2057 of 2026 is dismissed.

Memo of Evidence submitted be kept with the record.
