Mr. Soujanyo Pattanayak

... For the Petitioners.

Mr. L. Vishal Kumar, Mr. Sanjib Das

... For the State.

Learned advocate appearing for the petitioners submits that the subject-matter of the present case relates to alleged recovery of 309 bottles of Phensedyl from the joint possession of the petitioners and petitioners are in custody since 04.09.2023 i.e. for a period of almost 3 years 1 month. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioners pray for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that till date, four witnesses out of 16 witnesses have been examined. Having considered the period of detention of the present petitioners and as there are no antecedents reflected in the Memo of Evidence, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed.

2 Accordingly, the petitioners viz., 1. Bishal Kumar Paswan @ Vishal and 2. Dhananjay Paswan shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 4th Court, Alipore. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of South 24- Parganas without prior permission of the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2077 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
