In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NCB Crime No. 10/NCB/Kol/2015 u/s 21(c)/28/29 of the NDPS.

In the matter of : Anekwe Chinweze Alex @ Alex Anekwe Chinweze

… Petitioner(s)

Mr. Angshuman Chakraborty Mr. S. S. Saha

… for the Petitioner(s)

Mr. Anirban Mitra Mr. Priyankar Ganguly

… for the Union of India

The petitioner is in custody for more than two years eight months and there has been no recovery from the present petitioner. So far as present petitioner is concerned, he was arrested in connection with the case at Delhi, thereafter, he has been implicated in connection with the present case. Till date, only two witnesses have been examined and there is no possibility of the trial being concluded very soon, as such, he may be released on bail. Learned advocate for the NCB submits that the case is of the year 2015 and another co-accused has already been convicted in the present case. The petitioner is having three passports and had earlier come down to India at the relevant point of time, thereafter, fled away. The petitioner could only be traced after he was arrested in connection with the case at Delhi. I have taken into account the materials appearing in the case diary as well as the submissions of the learned advocate appearing for the respective parties. Having considered that the petitioner is a foreign national having different passports by which he entered India and fled away from this country from different airports, this court is of the opinion that if the petitioner is released on bail, he will not be available before the court because of his previous conduct and the materials which have been placed by the investigating agency. Having considered the same, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
