08.10.2026 Court No.35. D/L. 11. Kausik (Allowed)

CRM (NDPS) 2050 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachawk Police Station Case No. 0057 dated January 12, 2026 under Sections 21(c)/25/27A/29 of the NDPS Act, 1985.

And In the matter of : Bikram Barman

……Petitioner.

Mr. Shounak Mondal

……for the Petitioner.

Mr. Krishnendu Bhattaharya, APP Ms. Triparna Roy

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused person who has been granted bail in CRM (NDPS) 1107 of 2026.

State opposes the prayer for bail. However records reflect that there were two seizures, 47 bottles were recovered from the petitioner while 26 bottles were recovered from the other accused who has been granted bail.

Having considered the overall circumstances, I am of the opinion that petitioner be released on bail on same terms and conditions as was imposed upon Firoj Sk who has been granted bail in CRM (NDPS) 1107 of 2026.

Accordingly, CRM (NDPS) 2050 of 2026 is allowed.
