In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Gazole Police Station Case No. 1147 of 2025 dated 18.12.2025 under Sections 21(c)/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

... Petitioner.

Mr. Abhimanyu Banerjee, Mr. Arnab Saha, Mr. Abdul Nooman

... For the Petitioner.

Mr. L. Vishal Kumar, Mr. Sanjib Das

... For the State.

Learned advocate appearing for the petitioner submits that petitioner was shown arrested on or about 05.08.2025 and since then he is in custody. The subject-matter of the present case relates to alleged recovery of 1416 grams of Brown Sugar. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are criminal antecedents of the present petitioner being Mothabari P.S. Case No. 154 of 2026 and Siliguri P.S. Case No. 207 of 2023; both the cases are under the provisions of NDPS Act. Having considered the criminal antecedents of the present petitioner and the quantum of seizure in the present case, I am of the opinion that the petitioner has failed to

2 overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2082 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
