In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with STF WB HQ Police Station case no. 12 of 2025 dated 13.12.2025 under Sections 20(b)(ii)(c)/25/29 of the NDPS Act.

And In the matter of : Kabir Goldar @ Dafadar

……Petitioner. Mr. Angshuman Chakraborty, Ms. S. S. Saha

......for the Petitioner. Mr. Kallol Mondal, Ld. PP Mr. Anamitra Banerjee Mr. Sreyash Kumar Singh

……for the State.

Learned advocate appearing for the petitioner submits that petitioner has been foisted with the present criminal case pursuant to statement of co-accused from whom there has been alleged recovery of 45 kgs of ganja, charge-sheet has already been submitted and petitioner is innocent and has been languishing in custody. Learned advocate appearing for the State opposes the prayer for bail and submits that there is an antecedent of the petitioner being Rajarhat Police Station case no. 61 of 2026 which reflect that petitioner was not charge-sheeted in the said case. Having considered the submission of the respective parties and on an assessment of the materials so far as the present case is concerned, I am of the opinion that further custodial detention of

2 the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Kabir Goldar @ Dafadar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 2nd Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of North 24 Parganas without prior permission of the learned Special Court. Thus, CRM (NDPS) No. 2073 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Memo of evidence, compliance report and certified copy furnished today be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
