… for the State-respondent(s)

Learned advocate for the petitioner submits that before the Hon’ble Supreme Court, State submitted that they propose to examine only five witnesses and the same would be completed by December, 2025. The recovery in the present case is 20.414 kg of ganja. Having considered that more than 10 months have passed since the Hon’ble Supreme Court was pleased to reject the prayer for bail of the petitioner on undertaking given by the State with a liberty to renew his prayer for bail, I am inclined to release the petitioner on bail as number of witnesses proposed to examined till date has not been completed.

Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Krishna Roy shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 3rd Court, Asansol, Paschim Bardhaman. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Paschim Bardhaman without prior permission of the learned Special court/trial court or the court in seisin of the case. Accordingly, CRM (NDPS) 2089 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
