In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kalyani Police Station case no. 21 of 2025 dated 08.01.2025 under Sections 98/64(1)/351 of the Bharatiya Nyaya Sanhita, 2023 and under Section 6 of the POCSO Act, 2012.

And In the matter of : Barin Biswas @ Sunny

……Petitioner. Mr. Shibaji Kr. Das Ms. Deblina De

.....for the Petitioner. Mr. Pinaki Bhattacharyya Mr. Sourjyo Mukherjee Mr. Rishav Kumar Singh

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for one year nine months and charge-sheet has been submitted but till date neither the charge has been framed nor there is any further progress of the case. Learned advocate appearing for the State has produced the Case Diary. I have taken into account the statement of the victim. There is heinousness of the accusations against the present petitioner. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 2331 of 2026 is dismissed.

2 Learned trial Court is directed to ensure that the stage of charges be overcome within a reasonable period of time and with priority to the victim lady/girls be examined. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
