08.10.2026 Court No.35. D/L. 40. Kausik (Allowed)

CRM (NDPS) 2095 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chanchal Police Station Case No. 159/2026 dated 22.02.2026 under Section 21(c)/22(c) of the NDPS Act.

And In the matter of : Monowar Ali @ Rohit

……Petitioner.

Mr. Arnab Chatterjee

Mr. Anisur Rahaman

……for the Petitioner.

Mr. Gouranga Kumar Das Mr. Amal Kumar Das Mr. Debayan Ghosh

……for the State.

Records of the case reflect that petitioner was apprehended for alleged recovery of 25 bottles of Phensedyl.

Learned advocate for the State opposes the prayer for bail.

Having considered that similarly placed other accused persons have been granted bail in CRM (NDPS) 1229 of 2026, I am inclined to extend the same benefit to the present petitioner.

State has also submitted that there is an antecedent of the present petitioner but the same being under Section

2 379/411 of the Indian Penal Code, an opportunity in life is granted to the petitioner.

Accordingly, prayer for bail of the petitioner is allowed.

Petitioner be released by the learned Special Court on same terms and conditions as was imposed upon Dulal @ Anil in CRM (NDPS) 1229 of 2026.

Accordingly, CRM (NDPS) 2095 of 2026 is allowed.

Memo of Evidence submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
