IN THE HIGH COURT AT CALCUTTA Item No.25

CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2080 of 2026

In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Bizpore Police Station Case No. 183 of 2025 dated 07.09.2025 under Section 20(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And

In Re : Hira Das ... Petitioner.

Mr. Uday Sankar Chattopadhyay, Ms. Rajashree Tah, Ms. Trisha Rakshit, Ms. Bidisha Chakraborty, Ms. Sadia Parveen

... For the Petitioner.

Mr. Kaustuv Shome, Mr. Chandra Gupta Kamal

... For the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 13 months, charge-sheet has already been submitted and petitioner being a driver has unnecessarily been foisted with a case for alleged recovery of 88.400 kgs. of Ganja from two vehicles. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the quantum of seizure in the present case which is more than 88 kgs. Having regard to the same, I am not inclined to release the petitioner on bail as conscious possession was involved in the present case. As such, the prayer for bail of the petitioner is rejected.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2080 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
