…for the State

Petitioner is in custody in respect of another police case. Petitioner is the erstwhile Member of the Legislative Assembly in the State of West Bengal. Issue of false implication exists in the facts and circumstances of the present case. The alleged incidents of assault are of May 20, 2024. Police complaint is of 2026 Explanation of the State for delay in lodging the FIR is at that material point of time the defacto complainant could not lodge the FIR.

Considering the materials in the case diary and the fact that there is an issue of false implication, I deem it appropriate to grant anticipatory bail to the petitioner. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. The petitioner will report before the Investigating Officer once a week till the conclusion of the investigation as and when he is in custody in the other criminal cases. The petitioner shall appear on every date before the Jurisdictional Court on and from the date fixed as and when he is in custody in the other criminal cases for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. This application for anticipatory bail is, thus, allowed.
