08.10.2026 Serial no. 4 [G.S.Das] Assistant Registrar (Court)

CRM (M) 2544 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Kharagpur (Town) Police Station case no. 298 of 2026 dated 17.06.2026 [POCSO Case No. 97 of 2026].

-And-

In the matter of : Sk. Jumman Ali @ Jumman Khan

… Petitioner(s)

Mr. Noni Gopal Chakraborty Mr. Bappaditya Mukherjee

… for the Petitioner(s)

Mr. Aditya Tiwari Ms. Namrata Chatterjee

… for the State-respondent(s) Ms. Trina Mitra

… for the victim (HCLSA)

Learned advocate for the petitioner submits that the petitioner is in custody for more than three and half months; charge-sheet has been submitted and there is no possibility of the trial being concluded very soon, as such, learned advocate prays that the petitioner may be released on bail. Learned advocate for the defacto- complainant/private opposite party opposes the prayer for bail. State produces the case diary. I have taken in to account the statement of the victim under section 183 of the BNSS.

2 Having considered the same, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. The petitioner would renew his prayer for bail after the evidence of the victim is over. The learned trial court is directed, immediately after the consideration of charges, the victim on priority, be examined as a witness. Accordingly, CRM (M) 2544 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
