1. A prayer has been made by the petitioner to enlarge on bail on the ground of parity since the other co-accused similarly circumstanced with the present petitioner, has been enlarged on bail.

2. In this regard, the order passed by the learned co- ordinate Bench in respect of other witnesses are submitted before this Court.

3. The learned Prosecution raises objection however candidly submits that other co-accused, who are enlarged on bail, are similarly situated with the present petitioner. It further transpires that out of 41 witnesses, the Prosecution reduced the number of witnesses to 26 witnesses before the Learned Single Bench and more than 12 witnesses are yet to be examined. Therefore, there are remote possibility of completion of trial and hence, taking into account the period of detention and on the ground of parity, the present prayer of the petitioner for bail stands allowed.

4. Accordingly the petitioner, namely, Anil Mondal @ Ani @ Akash shall be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned ACJM, Sealdah subject to the following condition :

a) The petitioner shall not intimidate the witnesses and/or temper with evidence, in any manner whatsoever and shall not commit any cognizable offence in any manner whatsoever.

b) The petitioner shall appear before the Learned trial court on every date and shall not leave the jurisdiction of Kolkata Municipal Corporation without prior permission of the learned Trial Court.

c) In the event, the petitioner failed to comply with any of the condition stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court.

5. The application for bail is, thus, allowed.

6. The learned Trial Court is directed to expedite the hearing without granting any unnecessary adjournment to either of the parties considering the long pendency of the Trial.

7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

8. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (CHAITALI CHATTERJEE (DAS), J.)
