CRM (M) 2491 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Berhampore PS Case No. 1680 of 2025 dated 27th July, 2025 u/s 70(1)/143(4)/144(1)/61(2) of the BNS and u/s 3/4/5/6 of the Immoral Traffic (Prevention) Act and u/s 6 of the POCSO Act.

In the matter of : Shampa Shil Majumdar

… Petitioner(s)

Mr. Arnab Chatterjee Mr. Avik Ghosh

… for the Petitioner(s)

Mr. Pritam Roy Ms. Triparna Roy

… for the State-respondent(s)

The petitioner is in custody for one year two months and there is no possibility of the trial commencing in near future, as such, learned advocate for the petitioner prays that the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the petitioner is the principal accused who is not similarly situated with the other accused who have been granted bail. The statement of the victim under section 183 of the BNSS has been brought to the notice of this court.

Having considered the overall circumstances, at this stage, I am of the opinion that this is not a fit case for granting bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. However, as the petitioner is in custody for more than one year two months and till date charges have not been framed, the learned trial court is directed to expedite the process of consideration of charges, thereafter, give priority to the evidence of the victim. Accordingly, CRM (M) 2491 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
