07.10.2026 Court No.35. D/L.136. Rakib (Rejected)

CRM (NDPS) 2062 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 42 of 2026 dated 09.01.2026 under Sections 21(C)/27A/29 of the NDPS Act.

And In the matter of : Sajir Sardar @ Md. Safiul Islam

……Petitioner. Mr. Biswajit Tiwari Mr. Md. Sontu Mia Ms. Alisha Parvin Ms. Masuma Khatun Mr. Md. Aziz Alaman

......for the Petitioner. Mr. Dr. Pradip Banerjee Mr. P. Karan Singh Ms. Priyanka Bhattacharyya

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is similarly situated as other accused persons who have been granted bail in CRM (NDPS) 1279 of 2026. Learned advocate appearing for the State has submitted memo of evidence which reflects that there are four antecedents of the present petitioner, one of the case is under Section 302 of the Indian Penal Code and last of the case apart from the present case is registered on 10th of January, 2026 which is exclusively under the Arms Act. Having considered the nature of the cases and activities which the petitioner is involved, I am of opinion that rigors of Section 37 of the NDPS Act is attracted.

2 As such, prayer for bail of the petitioner in CRM (NDPS) 2062 of 2026 is dismissed at this stage. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
