07.10.2026 Court No.35. D/L. 118. Kausik (Rejected)

CRM (NDPS) 2026 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Balurghat Police Station Case No. 459 of 2025 dated 12.07.2025 under Sections 21(c)/22(c)/23(c)/25/27A/29 of the NDPS Act, 1985.

And In the matter of : Nasim Sarkar @ Nasim Rejvi

……Petitioner.

Mr. Kaushik Choudhury

……for the Petitioner.

Mr. Sayak Chakraborty

Mr. Rajesh Kr. Shah

……for the State.

Learned advocate for the petitioner submits that petitioner is renewing his prayer for bail as there has been no progress in the case since the petitioner’s earlier bail was rejected on 30.03.2026. Although there are other recoveries in the present case relating to Wincerex Cough Syrup but so far as the present petitioner is concerned, only 25 Gms. of Yaba Tablets were allegedly recovered from him.

State opposes the prayer for bail as not only the Yaba Tablets but also 2880 bottles of Wincerex Cough Syrup was recovered.

I have taken into account the earlier order dated 30.03.2026. Petitioner was arrested on July, 2025 and since

2 then he is in custody. Although charge sheet has been submitted but there has been no progress in the case. Although dates were fixed for deposition of the witnesses.

It has been pointed out by the State that the last rejection of splitting up of the trial has taken place and there has been some progress in the case.

Be that as it may, I direct that so far as the independent seizure list witnesses are examined, they may be examined by 31st January, 2027.

Petitioner would renew his prayer for bail after the aforesaid time period is over.

At this stage, prayer for bail of the petitioner in CRM (NDPS) 2026 of 2026 is dismissed.

Memo of Evidence submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
