1. It is submitted on behalf of the petitioner that he has been falsely implicated in this case, alleged to have been occurred after 2024 Lok Sabha Election. It is further submitted that petitioners are the sole earning member of the family and are completely innocent. It is submitted further that they have been implicated in this case merely on account of political rivalry and if the prayer is not allowed, they will highly prejudiced.

2. On behalf of the State objection has been raised.

3. Heard the submission. Perused the materials on record as well as the Case Diary and the statement collected in course of evidence. On careful perusal of the same, it transpires that there is an inordinate delay in lodging the complaint and no specific overt act in respect of the petitioners has been mentioned in the written complaint, or from any of the statement. Therefore, considering the nature of allegation this Court is of the view that custodial interrogation is not necessary. Accordingly, prayer stands allowed.

4. Accordingly in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 20,000/- (Rupees Twenty Thousand Only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of arresting officer and also subject to the condition as laid down in sub-section (2) of section 482 of BNSS. In addition to the above, the petitioner will follow the conditions which are as follows:-

a) The petitioners shall not intimidate the witnesses and/or tamper with evidence, in any manner whatsoever and shall not commit any cognizable offence in any manner whatsoever.

b) The petitioners shall appear before the Officer-in- Charge of the local police station once in a week, until further orders.

c) In the event, the petitioners failed to comply with any of the condition stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court.

6. The application for Anticipatory Bail is, thus, allowed.

7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

8. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (CHAITALI CHATTERJEE (DAS), J.)
