CRM (M) 2250 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jamalpur Police Station case no. 107 of 2026 dated 19.03.2026 under Section 4(2) of the POCSO Act, 2012.

And In the matter of : Tarapada Goswami

……Petitioner. Mr. Saheb Banerjee

.....for the Petitioner. Mr. Debapratim Guha

……for the State. Mr. Abhinav Rakshit

......for the De-facto complainant.

Learned advocate appearing for the petitioner submits that petitioner is a spiritual leader who has been falsely implicated in connection with the instant case and is in custody for more than six months, charge-sheet has already been submitted and charges have been framed, however, witness action has not commenced. Learned advocate appearing for the de-facto complainant opposes the prayer for bail. Learned advocate appearing for the State has drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. I have taken into account the same, having considered the said statement, I am of the opinion that without the completion of the evidence of the victim it would not be fit and proper to release

2 the petitioner on bail. As such, prayer for bail of the petitioner is rejected. Learned trial Court is directed to expedite the process of examination of the victim. With the aforesaid observations, CRM (M) 2250 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
