1. The instant revisional application is at the behest of the petitioner/wife of the opposite party, praying for expeditious disposal of the petition for maintenance filed under Section 125 of the Cr.P.C., being Case No. M- 51/2020 pending before the learned Judicial Magistrate, 2nd Court, Barasat, North 24-Parganas.

2. It is submitted by the learned Counsel for the petitioner that the petitioner has been residing separately since 2020 and the opposite party/her husband has been neglecting her; as such, she has filed the application for maintenance against the husband. Despite filing the application for maintenance in the year 2020, no interim order or final order of disposal was passed by the Trial Court after concluding the hearing.

3. The Maintenance application should be decided as far as possible within a reasonable time, but even after expiry of six years, such application could not be disposed of by the Trial Court; as such, the prayer is simple and innocuous. This prayer may be allowed as the Hon’ble Supreme Court consistently ruled that the Trial Court should expedite maintenance proceedings.

4. In view of the above facts and circumstances, this revisional application is disposed of with a direction to the Trial Court to dispose of the proceeding pending under Section 125 of the Code of Criminal Procedure as expeditiously as possible, independently and in accordance with law.

5. This Court hopes and trusts that the matter may be heard as early as possible and taken to its logical conclusion.

6. With the above observations, CRR/4096/2026 is disposed of. Connected application, if any, is also, thus, disposed of.

7. Let a copy of this order be communicated to the learned Trial Court for information and necessary steps.

8. All parties are to act on the server copy of this order duly downloaded from the official website of the Calcutta High Court.

9. Urgent xerox certified copy of this order, if applied for by the parties, same shall be supplied upon compliance of the necessary formalities.
