1. None appears on behalf of the respondents. Even on earlier occasion, none represented the respondents, nor has accommodation been sought.
2. The learned Counsel appearing on behalf of the petitioner submits that this case has been pending since 2017. Although the writ petitioner was allotted a quarter, it was not handed over to him because the ex-employee had possession of the same.
3. It is further submitted that the petitioner made several prayers and representations, and lastly issued a demand notice, but in vain; as such, the petitioner filed this writ petition seeking relief, so that his allotted quarter may be handed over to him.
4. Petitioner prays for direction upon the respondent no. 5 to consider his representation for allotment of quarter as per his entitlement.
5. Having heard the submission and upon perusal of the materials available on record and affidavits exchanged between the parties, this court finds that the petitioner is working as a ‘Dumper Operator’ in Bharat Coking Coal Limited. He was allotted a quarter in the year 2002, but the same was not vacated by the ex- employee. He had made several representations, and finally a demand notice was issued to the higher authorities, but no result and the same is still under consideration
6. This Court deems it fit and proper to dispose of this case considering the nature of prayer and long pendency.
7. The respondent no. 5 is directed to consider the claims of the petitioner and dispose of the same after affording an opportunity of hearing the petitioner and necessary parties, if any, within eight weeks from the date of communication of this order together with copy of the writ petition in connection with the allotment of a quarter in favour of the petitioner as per his entitlement and pass reasoned order in accordance with law and copy of the same be handed over to the petitioner within one week thereof.
8. With the above observations, WPA/24207/2017 is disposed of. Connected applications, if any, are also, thus, disposed of.
9. Interim order, if any, stands vacated.
10. All parties are to act on the server copy of this order duly downloaded from the official website of the Calcutta High Court.
11. Urgent xerox certified copy, if applied for by the parties, same shall be supplied upon compliance of the necessary formalities.
