CRM (NDPS) 2048 of 2026
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Balurghat Police Station Case No. 350 of 2026 dated 29.05.2026 under Sections 21(c)/22(c)/23(c)/28/29 of the NDPS Act, 1985.
And In the matter of : Sanjit Barman @ Sanajit Barman @ Patal
……Petitioner.
Mr. Kaushik Choudhury
Mr. Dwaipayan Panda
……for the Petitioner.
Mr. Anindya Ghosh Mr. Pronojit Roy
……for the State.
Learned advocate appearing for the petitioner submits that he has been implicated on the basis of statement of co- accused, although the recovery in the present case from the other accused is 198 bottles of Eskuf Cough Syrup.
Learned advocate for the State opposes the prayer for bail and submits that there are CDR available of the present petitioner and from one of the accused seizure has been effected. However, there is a criminal antecedent of the present petitioner being Balurghat PS Case No. 559 of 2025 under the provisions of the NDPS Act.
2
Having considered the antecedents of the present petitioner as well as his complicity, I am of the opinion Section 37 of the NDPS Act is attracted.
As such prayer for bail of the petitioner in CRM (NDPS) 2048 of 2026 is dismissed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
