IN THE HIGH COURT AT CALCUTTA Item No.M/L.79

CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 1780 of 2026

In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with STF Police Station Case No. 03 of 2022 dated 25.01.2022 under Sections 120B/489B/489C of the Indian Penal Code, 1860 and charge-sheet submitted under Sections 120B/489B/489C of the Indian Penal Code, 1860 and under Sections 16/17/18 of the Unlawful Activities (Prevention) Act.

... For the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 4 years 8 months. Learned advocates for the petitioner and the State submit that six witnesses have been examined and evidence of PW-7 is in progress. Report submitted by the Officer-in-Charge, STF Police Station, Kolkata reflects that after the evidence of PW-7, who is the first Investigating Officer, is completed, the prosecution intends to examine only the second Investigating Officer of the case, although two more witnesses are there in the charge-sheet submitted by the prosecution.

2 In view of the prosecution intending to examine only one witness more, I am of the opinion as a last opportunity prosecution is granted till 15.01.2027. Learned court in seisin of the case will leniently consider the prayer for bail after 15.01.2027, if after extending all cooperation by the accused, the prosecution is unable to complete the deposition of the witnesses. At this stage, the prayer for bail of the petitioner is rejected. Report submitted by the learned advocate appearing for the State be kept with the record. A copy of the said report be handed over to learned advocate for the petitioner. The application for bail, being CRM (M) 1780 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
