Howrah SMVB Duronto Expression. Learned counsel submits that in the contract agreement, it was specifically mentioned that the contract is governed as per existing Railway

Board Circular as well as the amendment from time to time. Learned counsel further submits that at the time of the award of the contract as per Rule 14.3 of Freight Marketing Circular Rule 12/2022. The contract was liable to be terminated if the overloading is detected on more than two occasions in any one contract. Learned counsel submits that this provision was modified vide circular dated 24th March, 2026 as per modified provisions, the contract can be terminated only if the overloading is detected on more than four occasions.
