In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gangarampur Police Station case No. 15 of 2026 dated 09.01.2026 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the NDPS Act.
And In the matter of : Ainul Miah @ Nutu
……Petitioner. Ms. Sujata Das
......for the Petitioner. Mr. Brojesh Jha Mr. Arijit Bhusan Bagchi Mr. Arka Mukherjee
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for 129 days, charge-sheet has already been submitted, petitioner has been implicated on the basis of the statement of co-accused. There is no possibility of the trial being concluded in near future. As such, petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that there are call data records are available between the petitioner and the accused persons from whom seizure has been effected. Attention has also been drawn of this Court that there are criminal antecedents of the present petitioner as there is another case at Kushmandi Police Station under the NDPS Act. Having considered the materials appearing in the report submitted by the police authorities, I am of the view that rigors of Section 37 of the NDPS Act is attracted in the present case.
2 As such, prayer for bail of the petitioner in CRM (NDPS) 2064 of 2026 is rejected. Memo of evidence submitted by the State kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
