In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Tehatta PS Case No. 264 of 2025 dated 09.04.2025 u/s 351(2) of the BNS and sections 6 of the POCSO Act [Nadia in POCSO Case No. 27 of 2025].

In the matter of : Sanjit Majumder @ Sanjit Mazumdar

… Petitioner(s)

Mr. Jayanta Narayan Chatterjee, Sr Adv. Ms. Moumita Pandit Mr. Gautam Malik Ms. Ritushree Banerjee

… for the Petitioner(s) Mr. Gouranga Kumar Das, APP Mr. Sanjib Das

… for the State-respondent(s) Ms. Poulami Bose

… for the defacto-complainant

Learned Senior advocate appearing for the petitioner submits that the petitioner is in custody for one year six months and the evidence of the father of one of the victims has been completed. Learned advocate also submits that the evidence of the said witness reflects that she has turned hostile. Learned advocate for the defacto-complainant leaves it to the discretion of the court. State opposes the prayer for bail. Having regard to the fact that the petitioner is in custody for one year six months and only one witness has been examined out of the 13 witnesses cited in the charge- sheet which will consume some time to take the trial to its logical conclusion, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sanjit Majumder @ Sanjit Mazumdar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, Tehatta, Nadia & Special Court (POCSO). If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Nadia without prior permission of the learned Special court/ trial court or the court in seisin of the case. Accordingly, CRM (M) 2594 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence and notice submitted be kept with the record.
