IN THE HIGH COURT AT CALCUTTA Item No.117

CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2016 of 2026

In Re : An Application for bail Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NCB Siliguri Crime Case No. 01/NCB/SLG of 2026 dated 09.01.2026 under Section 8(c) read with Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

In Re : Afchhar Mondal ... Petitioner.

Ms. Busra Khatun, Md. Kashif Alam

... For the Petitioner.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than eight months; charge-sheet has already been submitted. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Records of the case reflect that more than 7200 bottles of Codeine Mixture were recovered and the recovery was also from the present petitioner. None appears for the NCB. Having considered the quantum of recovery in the present case, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. Petitioner would renew his prayer for bail after the evidence of seizure list witnesses is over. Learned Trial Court would give priority to the evidence of seizure list witnesses.

2 The application for bail, being CRM (NDPS) 2016 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
