……Petitioner. Mr. Arup Kumar Bhowmick
......for the Petitioner. Mr. Dipankar Dandapath Mr. Pradip Kumar Kundu
……for the NCB.
Learned advocate appearing for the petitioner submits that petitioner is in custody for five months and there are no materials against him except the statement of the co-accused. Learned advocate appearing for the NCB submits that the recovery in the present case is 3375 bottles of phensedyl along with 6 kgs of ganja. Additionally, petitioner was absconding for more than four years. There are call data records available between the accused from whom seizure has been made and the present petitioner. Having considered the aforesaid circumstances, I am of the opinion that petitioner is not entitled to be released on bail at this stage as provisions of Section 29 of the NDPS Act is attracted in the present case. Thus, CRM (NDPS) 2063 of 2026 is dismissed. Report submitted by the NCB be kept with the record.
