1. The petitioner claims to be the widow of one Sanat Kumar Biswas, who was serving as an Assistant Teacher of a school. The teacher died in harness on 6th July, 2023. The petitioner prays for a direction upon the respondent authorities to consider her claim for grant of family pension.
2. On a perusal of the documents annexed to the writ petition, there is nothing on record to suggest that the petitioner ever applied before the respondent authority for grant of family pension in her favour. There is no proof annexed to the writ petition in support of her marriage to the deceased. It has been submitted that the marriage took place in the year 2001, after the death of the first wife of the deceased teacher.
3. Learned advocate representing the State respondents relies on the instruction forwarded by the District Inspector of Schools (SE), Howrah signed on 5th
October, 2026. It has been mentioned therein that the prayer of the petitioner for release of terminal dues will be processed immediately after necessary documents are submitted by the petitioner.
4. After hearing the parties and on perusal of the documents placed before the Court, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to apply for the benefits that she seeks along with all necessary documents in support of her claim.
5. On receipt of all necessary relevant documents from the petitioner, the respondent authority shall take steps to process the claim of the petitioner in accordance with law.
6. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
7. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
