CRM (NDPS) 2051 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Bolpur PS case no. 330 of 2024 dated August 10, 2024 u/s 20(b)(ii)(C)/25/29 of the NDPS Act [C. Csae No. 09 of 2024].

-And-

In the matter of : Sk. Kota @ Sk. Kata

… … Petitioner(s)

Mr. Ayan Basu Mr. Srinjan Ghosh

… for the Petitioner(s)

Mr. [Name not supplied]

… for the State-respondent(s)

Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused [Sk Sajahan @ Sk Sahajan] who has been granted bail by the Hon’ble Supreme Court in a Special Leave to Appeal (Crl.) No. 11813 of 2026. State opposes the prayer for bail but is unable to refute the locus of the present petitioner with that of Sk Sajahan who has been granted bail by the Hon’ble Supreme Court. Having considered the same, I am inclined to release the petitioner on bail on such terms and conditions as was imposed upon Sk Sajahan by the Hon’ble Supreme Court. Hence, the prayer for bail of the petitioner [Sk. Kota @ Sk. Kata] is Allowed.

2 Accordingly, CRM (NDPS) 2051 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
