Learned advocate appearing for the petitioner submits that although 504 bottles of cough syrup was recovered but the same was recovered from two different persons and no recovery was effected from the present petitioner. The petitioner is in custody since 21.06.2026. Therefore, learned advocate prays that the petitioner may be released on bail. State opposes the prayer for bail as the investigation is in progress. There are individuals who have deposed that the petitioner was responsible for such offence being committed. I have taken into account the materials appearing in the case diary but on a specific query from the court, the learned advocate, on perusal of the case diary as well as the Memo of evidence, submits that there are no criminal antecedents against present petitioner but there is no CDR and/or money trial is available in respect of the present petitioner with the other accused persons involved in the present case. Having considered the same, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Debasish Halder @ Pagla shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), Krishnanagar, Nadia. If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till the report in final form is submitted before the learned Special court. Accordingly, CRM (NDPS) 2024 of 2026 is allowed.

Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
