In Re : Nijamuddin

... Petitioner.

Mr. Navanil De, Mr. Srinjan Ghosh

... For the Petitioner.

Mr. Ronojoy Chatterjee, Mr. Debapratim Guha

... For the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than eight months and has been implicated on alleged recovery of 138 bottles of Codeine Mixture from joint possession of petitioner and another. Petitioner submits that although charge-sheet has been submitted, but till date, charges have not been framed and there is no possibility of the charges being framed in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that prayer for bail of the co-accused has been rejected. Petitioner is in custody for eight months. Learned Special Court is directed to split up the trial of the case, if any of the accused persons are absconding and proceed towards consideration of charges.

At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the stage of consideration of charges is over. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2045 of 2026, is, thus, disposed of. Learned advocates for the petitioner and the State are directed communicate this order to the learned Trial Court forthwith. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
