CRM (NDPS) 2035 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Baishnabnagar PS Case No. 233 of 2026 dated 06.03.2026 u/s 21(c)/27A/29 of the NDPS Act.

… … Petitioner(s)

Mr. Saryati Dutta Mr. Arup Sarkar Mr. Sourav Mukherjee Mr. Gourav Roy

… for the Petitioner(s)

Mr. Pritam Roy Mr. Tatini Sengupta

… for the State-respondent(s)

Learned advocate for the petitioners submits that there has been alleged recovery of 24 bottles of codeine mixture from the joint possession of the petitioners with others. The petitioners are in custody since 6th March, 2026 and charge-sheet has already been submitted. State opposes the prayer for bail but on a specific query from this court, learned advocate submits that there are no criminal antecedents of the present petitioners. Having considered that the prosecution intends to rely upon 13 witnesses in order to prove its case and there are no criminal antecedents of the present petitioners, I am of the opinion that further detention of the present petitioners is unwarranted. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, [Sefali Bibi and Abdul Khalek] shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 3rd Court, Malda. If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court or the court in seisin of the case. Accordingly, CRM (NDPS) 2035 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
