CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 2040 of 2026

In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with English Bazar Police Station Case No. 2098 of 2025 dated 19.09.2025 under Sections 21(c)/25/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And

In Re : Moazzem Hossain

... Petitioner.

Mr. Anwar Hossain, Ms. Sabrina Parveen

... For the Petitioner.

Mr. Amarta Ghose, Mr. Arindam Banerjee

... For the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than a year and till date, only charge has been framed, but witness action has not commenced. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as there has been alleged recovery of 1000 bottles of Phensedyl from the joint possession of the petitioner and another. Having considered the quantum of seizure in the present case, an opportunity is granted to the prosecution to examine all the independent seizure list witnesses within a period of three months from date. At this stage, the prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after three months from the date of communication of this order to the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2040 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
