CRM (M) 1713 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with S.T. 26(9) 2025 corresponding to SC 131 of 2025 arising out of Chandannagar Cyber Crime Police Station Case No. 30 of 2024 dated 14.11.2024 u/s 318(4)/316(2)/317(4)/61(2) of the BNS, 2023 and Sections 66/66D of the IT Act.

… Petitioner(s)

Mr. Bitasok Banerjee Ms. Debangana Bhattacharya

… for the Petitioner(s) Mr. Kallol Mondal, PP Mr. Brajesh Jha, ld. APP Mr. Moyukh Mukherjee Ms. Shalu Gupta

… for the State-respondent(s)

Learned Advocate appearing for the petitioner submits that the petitioner was shown arrested in connection with the instant case on December, 2024 and is in custody for about one year ten months. Learned advocate also submits that charge-sheet has been submitted; two Supplementary Charge-sheet have also been submitted and as directed in CRM (M) 1018 of 2026 in respect of a co- accused, eight witnesses have already been examined. State submits that they have scaled down number of witnesses to 23. I find that presently the case is before the learned Additional Sessions Judge, 1st Court, Chinsurah. The accusations against the present petitioner are that he added the principal accused in the commission of the alleged offence. The merits of the case definitely have an impact, but, at the same time, the materials which have been collected by the investigating agency do not reflect that there is any scope of further tampering with the evidence. Having regard to the period of detention already suffered, the time which will be consumed to take the trial to its logical conclusion as also the fact that the case is based on documents and digital evidences, I am of the opinion that further custodial detention of the present petitioner is not warranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Nishek Alam shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned CJM, Chinsurah, Hooghly. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall leave the district of Hooghly by informing the learned trial court or the court in seisin of the trial/case. Accordingly, CRM (M) 1713 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observations made above are only restricted for adjudication of the bail application and should not be considered as final opinion on the merits of the case. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
