CRM (NDPS) 2038 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Khargram PS Case No. 121 of 2025 dated 18th March, 2025 u/s 20(b)(ii)(c)/29 of the NDPS Act [NDPS Case No. 56 of 2025].

… Petitioner(s)

Mr. Arnab Chatterjee Mr. AVik Ghosh Ms. Ankusha Ghosh

… for the Petitioner(s)

Mr. Ayan Basu Mr. Goutam Banerjee

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner is in custody for one year six months and the earlier direction of this court to examine the seizure list witnesses, till date, has not been completed. Learned advocate adds that there is no possibility of the trial being concluded very soon as the prosecution has relied upon 23 witnesses in order to prove its case. State opposes the prayer for bail in view of more than 44 kg of ganja having been recovery from the joint possession of the petitioner and another. Having considered the same, last opportunity is granted to the prosecution to complete the evidence of the seizure list witnesses by 15th December, 2026. If, the

2 evidence of the seizure list witnesses is not completed by 15th December, 2026, the learned trial court would release the petitioner on bail on such terms and conditions as it would deem fit and proper for ensuring further appearance of the petitioner before the court during the trial. With the aforesaid observations, CRM (NDPS) 2038 of 2026 is disposed of. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
