... Petitioner.

Mr. Kaushik Choudhury, Mr. Dwaipayan Panda

... For the Petitioner.

Mr. Gouranga Kumar Das, APP, Mr. Amal Kumar Datta, Mr. S. S. Basu

... For the State.

Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 113 bottles of Phensedyl and petitioner is in custody for more than ten months. It has been submitted that charge-sheet has already been submitted and there is no possibility of the trial concluding in near future as some of the accused persons are absconding. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the quantum of recovery in the present case is above commercial quantity. I have taken into account the quantum of seizure in the present case. A last opportunity is granted to the prosecution to split up the trial of the case and ensure that the stage of consideration of charges is completed by 15.12.2026. At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the aforesaid time period is over. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 2055 of 2026, is, thus, disposed of. Learned advocate for the State is directed to communicate this order to the learned Trial Court. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
