CRM (NDPS) 2023 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Panchla PS Case No. 383 of 2021 dated 25.11.2021 u/s 20(b) of the NDPS Act.

In the matter of : Badsha Sk. @ Sk. Badsha.

… Petitioner(s)

Mr. Mrityunjay Chatterjee Mr. Debarnab Adhikary

… for the Petitioner(s)

Mr. Subrata Mukherjee Mr. Avishek Bhandari

… for the State-respondent(s)

The petitioner was earlier granted bail in CRM (NDPS) 1973 of 2023. Subsequently, he was not available before the court and pursuant to the warrant of arrest being executed, he had been arrested and is in custody since 28.07.2025. The petitioner already has suffered the custody for more than three years. The subject-matter of the case according to the petitioner is alleged recovery of 22.335 kg of ganja. State opposes the prayer for bail as the petitioner has misused the liberty granted. I have taken into account the period of detention and the fact being pointed out by the State that next schedule is fixed from 6th October, 2026 to 9th October, 2026.

2 Having considered the same, I direct the learned trial court that if rest of the witnesses is not completed within the said schedule, the learned trial court would release the petitioner on bail after 9th October, 2026 on such terms and conditions as the learned trial court would deem fit and proper for ensuring further appearance of the petitioner before the learned trial court. With the aforesaid observations, CRM (NDPS) 2023 of 2026 is disposed of. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
