In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NDPSCse no. 12 of 2024, being NCB Crime No. 09 of 2024 dated 26.04.2024 u/s 8(C)/22/23/29/35 and 54 of the NDPS Act.

In the matter of : Jhilam Khanna

… Petitioner(s)

Mr. Raja Mukherjee

… for the Petitioner(s)

Mr. Krishnendu Bhatacharyya Mr. Sagar Saha

… for the NCB

The petitioner is in custody for about two years six months and only four witnesses till date have been examined. There is no possibility of the trial being concluded very soon. Therefore, learned advocate, prays that the petitioner may be released on bail. Learned advocate for the NCB submits that two more witnesses are left to be examined. I have taken into account the fact that the delay in the present case is because of some of the accused persons are connected with a case at Delhi which is pending. So far as the modus operandi of carrying out the act and actions in respect of transporting the contraband is concerned, the same is the subject-matter of the present prosecution’s case.

The merits of the case have already been taken into consideration earlier. The report which has been submitted by the NCB reflects that two more witnesses are proposed to be examined in support of the case. Having considered the same and the manner in which the facts of the prosecution’s case have been placed, I am of the opinion that some more time is to be given to the prosecution. Accordingly, as a last opportunity, six months’ time is granted to the prosecution to complete the trial, or, in the alternative, the petitioner would be at liberty approach this court for renewal of bail. At this stage, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
