In the matter of : Roni Mondal

… Petitioner(s)

Mr. Kaushik Choudhury Mr. Dwaipayan Panda

… for the petitioner(s)

Mr. Krishnendu Bhattacharyya, ld.APP Mr. Sankalpa Bhattacharjee

… for the State-respondent(s)

Learned advocate for the Petitioner submits that there has been no recovery from the present petitioner and he has been falsely implicated on the statement of co- accused. Mr. Bhattacharjee, learned APP, appears for the State along with a junior of his choice. The appointment of both Mr. Bhattacharjee and the junior of his choice, if any, be regularized by the concerned authority. State opposes the prayer for anticipatory bail and submits a report which reflects that there are no criminal case against the present petitioner; neither any CDR nor any money trial has been traced. Having considered the overall circumstances, I direct that the petitioner be granted the relief of anticipatory bail. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Roni Mondal] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain valid for a period of four weeks from date. Accordingly, CRM (A) 979 of 2026 is disposed of. Reports and the Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
