1. Apprehending arrest in course of investigation of Bhatar P.S. Case No.334 of 2026 under Sections 329(4)/ 115(2)/ 308(2)/ 324(2)/ 351(3)/3(5) of the B.N.S.S. and the petitioner has come praying for anticipatory bail.

2. It is submitted on behalf of the petitioner that they have been falsely implicated due to political rivalry and he is not connected with the case. There is inordinate delay in preferring this application and other co-accused persons are enlarged on anticipatory bail.

3. The learned counsel on behalf of the State raises objection.

4. Heard the submission of both the learned counsels. On perusal of materials on record and the case diary, it transpires that the incident alleged is of the year 2021 and 2024 in respect of post- poll violence. No specific over act can be found against the present petitioner. The delay in lodging the complaint is without any explanation. The political rivalry is very much evident however, there is no seizure of medical document or to support ransacking the houses.

5. In view of the above facts and circumstances of the case and considering the other co-accused persons are on anticipatory bail this court is inclined to allow the prayer on the ground of parity since custodial interrogation is not warranted. Therefore the prayer for anticipatory bail stands allowed.

6. Accordingly the petitioner, namely, Debabrata Dutta @ Sonu shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Chief Judicial Magistrate, Purba Bardhaman subject to condition as laid down in sub-section (2) of section 482 of BNSS. In addition to the above the petitioner will follow the conditions which are as follows:-

a) The petitioner shall not intimidate the witnesses and/or temper with evidence in any manner whatsoever and shall not commit any cognizable offence in any manner whatsoever.

b) The petitioner shall appear before the officer-in- charge of the local police station once in a week, until further orders.

c) In the event, the petitioner failed to comply with any of the condition stipulated above, the trial Court shall be at liberty to cancel the bail in accordance with law without further reference to this Court.

7. The application for bail is, thus, allowed.

8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

9. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (CHAITALI CHATTERJEE (DAS), J.)
