CRM (NDPS) 1836 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jalangi Police Station case no. 266 of 2026 dated 20.06.2026 under Sections 20(b)(ii)(C)/29 of the NDPS Act.
And In the matter of : Bishu Mondal @ Bisha @ Biswajit Mondal
……Petitioner. Mr. Jisan Iqubal Hossain
......for the Petitioner. Mr. Gouranga Kumar Das, Ld. APP Mr. Madan Mohan Roy Mr. Haripada Nayak
……for the State.
Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner, although, from other accused person 34.359 kgs of ganja were recovered. Learned advocate appearing for the State opposes the prayer for bail and submits that there are call data records available which are between the present petitioner and the other accused who has been arrested. Having considered the fact that investigation of the case is still in progress and there are prima facie materials, at this stage, I am of the opinion that the rigors of Section 37 of the NDPS Act is applicable. As such, prayer for bail of the petitioner in CRM (NDPS) 1836 of 2026 is rejected.
