05.10.2026 Court No.35. M/L.53. Rakib (Rejected)

CRM (M) 1517 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Harishchandrapur Police Station case no. 1164 of 2025 dated 30.10.2025 under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Bharat Mandal

……Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Arnab Sau

……for the State.

Learned advocate appearing for the State has drawn the attention of the Court to the statement of the mother of the deceased as also the eye-witness. Attention has been drawn to the offending weapon which has been seized at the behest of the present petitioner. Materials collected by the investigating agency reflect that the deceased was assaulted with a sword and he was beheaded from his body by one slash of the sword. In view of the heinousness of the offence, I am not inclined to release the petitioner on bail. As such, prayer for bail of the petitioner in CRM (M) 1517 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
