CRM (M) 1271 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with FIR case no. RC0562024S0004 dated 16.02.2024 u/s 363/365/366/368/370/370A/376(3) of the IPC and section 4 and 6 of the POCSO Act and Sections 9 and 10 of the Prohibition of Child Marriage Act [Raina PS FIR No. 379 of 2023 dated 17.08.2023].

In the matter of : Petitioner

… Petitioner(s)

Mr. Zohaib Rauf Mr. S. Dey

… for the Petitioner(s)

Mr. [Name not supplied]

… for the State-respondent(s) Mr. Amajit De

… for the CBI, Spl. PP

The petitioner prays for bail as he has married the victim and has been falsely implicated in the instant case. It is additionally submitted that the petitioner had no knowledge regarding the age of the victim, as such, his implication in the instant case is on his innocence and not attended with any mala fide. CBI opposes the prayer for bail and submits that it is the petitioner who purchased the girl in lieu of money and a racket was operating which after the CBI was vested with the power, was busted.

I find that nine witnesses have been examined. Primarily, the locus of the present petitioner is clear so far as the sexual offence which have been committed. Having regard to the overall circumstances of the case including the manner in which the recovery of the minor was done at the instance of the investigating agency, I am of the opinion that this is not a fit case for granting bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1271 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Written report submitted by the CBI be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
